The Deregulation Act came into force on 26 March 2015 to clarify tenancy deposit protection requirements.
What has made letting agents and landlords breathe a sigh of relief is confirmation that if a deposit is already correctly protected and Prescribed Information (PI) served, the Housing Act does not require re-protection and new PI when the tenancy is replaced by a fixed term or Statutory Periodic Tenancy (SPT) where the tenant(s), landlord(s), premises and scheme remain the same.
But the law also confirms that some landlords will need to ensure the deposit is protected where the tenancies overlap the introduction of the Housing Act on 6 April 2007.
